Delhi HC Orders Authorities To Take Action Against Cars With Bull Bars | V3Cars

The Delhi High Court has asked authorities to take strict action against cars and SUVs fitted with bull bars in the national capital region. Earlier in December 2017, the ministry of road transport and highways directed all states to take stern action against illegal modification on vehicles. In 2018, the Delhi High Court stayed the central ministry’s notification, leading to a freeze in issuance of challans against offending vehicles. However, the court vacated the stay in 2019.

Cars With Bull Bars To Face Action In Delhi-NCR

A bench of Chief Justice Satish Chandra Sharma and Justice Tushar Rao Gedela ruled that "crash guards and bull bars on motor vehicles are not permitted, and government agencies must strictly enforce the provisions of the Motor Vehicles Act."

Anil Soni, the Centre's standing counsel, claimed that crash guards and bull bars could cause serious injury to pedestrians if a car struck them. If a car equipped with a crash guard is involved in an accident, the airbags will not deploy, raising safety concerns, he added.

The court’s directive comes after hearing a plea filed by Aarshi Kapoor and Sidharth Bagla. The plea claimed that while these bumpers may appear stylish, they defeat the car's in-built safety features in high-speed accidents, resulting in serious and fatal injuries.

Another petition was filed in court by Mohammed Arif, who claimed to be a maker and distributor of crash guards and bull bars and had contested the ministry's 2017 directive to states. He contended that the Centre's judgement was unconstitutional because there was no regulation, legislation, or by-law governing accessories such as crash guards or bull bars.

We welcome the latest order from the Delhi High Court. Bull bars do affect the safety of a vehicle as they render the crumple zones in a vehicle useless by transferring collision energy straight to the body structure, resulting in injuries and death to occupants. They also affect the airbag sensors during a crash, thus preventing them from deploying.

Bull bars also endanger pedestrians and 2-wheelers. Bull bars that protrude out of a car inflict catastrophic injury and death to other road users during a crash, especially when cars are built to decrease the effect of a crash on pedestrians. They also harm a car's chassis during a major collision because the impact is disproportionately dispersed, causing the crash energy to be forced onto the body structure.
